Impakt Entertainment LLC Transportation Liability Disclaimer

This transportation liability disclaimer (“Disclaimer”) is provided by Impakt Entertainment LLC (“Company”) and applies to all transportation services provided by the Company for the festival (“Event”). By utilizing the transportation services offered by the Company, you (“Customer”) acknowledge and agree to the terms outlined in this Disclaimer.

Assumption of Risk: Customer understands and acknowledges that transportation to and from the Event involves certain inherent risks, including but not limited to traffic accidents, delays, unforeseen events, and other transportation-related issues.

Release of Liability: Customer agrees to release, waive, discharge, and covenant not to sue the Company, its affiliates, employees, agents, contractors, and representatives from any and all liabilities, claims, demands, actions, or causes of action arising out of or related to transportation services to and from the Event, including but not limited to personal injury, property damage, or any other loss.

Indemnification: Customer agrees to indemnify and hold harmless the Company and its affiliates from any claims, demands, liabilities, costs, or expenses (including legal fees) arising out of or related to any actions or negligence of the Customer, their guests, or any third parties, during the transportation to and from the Event.

Limitation of Liability: In no event shall the Company be liable for any direct, indirect, special, incidental, consequential, or punitive damages arising out of or related to the transportation services provided to and from the Event, even if the Company has been advised of the possibility of such damages.

All Sales Final: All sales are final, and no refunds will be provided. However, tickets are transferable to another individual.

Operational Conditions: Buses will operate regardless of weather conditions, including rain or shine.

Shuttle Service Provider: These shuttles are operated by Modal, an independent shuttle service provider. The Company assumes no liability for the actions, operations, or services provided by the shuttle service provider.

First Come, First Served: Shuttles will operate under a first come, first served system. Availability on the shuttles is not guaranteed and is subject to space limitations.

Access to Shuttles: To gain access to the shuttles, Customers must be in the shuttle lines with their valid tickets during the stated pickup time. Failure to be present within the designated time may result in denied access to the shuttles.

Jurisdiction: This Disclaimer shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising out of or related to this Disclaimer shall be subject to the exclusive jurisdiction of the courts of [Your Jurisdiction].

By utilizing the transportation services provided by Impakt Entertainment LLC, the Customer acknowledges that they have read, understood, and agreed to the terms of this Disclaimer.
